Intellectual Property Rights

​Regulations in Indonesia for the registration of Intellectual Property Rights (IPR) have several stages, such as:


PRE-APPLICATION STAGE

  1. Conduct an initial examination of the Intellectual Property (IP) that will be registered, to check whether the IP have similarities with others.

  2. The applicant will get the results of the examination in writing.

  3. The examination is carried out based on our database, the database of the Directorate General of Intellectual Property Rights, and the general database that can be found through the website.


APPLICATION SUBMISSION STAGE


Requirements:

  1. Registration by personal:

    1. Signing power of attorney and statement letter

    2. Attach a photocopy of the applicant's ID card

    3. Attach a softcopy of the proposed label/brand design in JPEG format

  2. Registration by company:

    1. Signing power of attorney and statement letter (by the Director)

    2. Attach a photocopy of the Director's ID card

    3. Attach a photocopy of the company's deed of establishment

    4. Attach a photocopy of the deed of appointment of the Director

    5. Attach a softcopy of the proposed label/brand design in JPEG format


APPLICATION PROCESS STAGE


1. Formality check stage

At this stage, the Government will conduct a formality check, namely the application will be examined regarding the completeness of the documents. If the required documents are complete, the Government will provide a date for the application for registration. The time required by the Government to carry out a formality check is normally 15 working days.


2. Announcement / publication stage

If the formalities are complete, then within 2 months, the Government will publish (via the official government website) the submitted application.


3. Substantive examination stage

After the announcement/publication period is over, within 150 working days, the Government will conduct a substantive examination.


4. Certificate issuance stage

If in the substantive examination, the Government decides to accept the application, a certificate will be issued stating an approval. The certificate will be issued within 30 working days.



VALIDITY PERIOD

The certificate is valid for 10 yearsand must be extended while still using the Intellectual Property Rights.



SCOPE OF WORK


The scope of work that will be carried out is:

  1. Submit a registration application to the Directorate General of Intellectual Property Rights.

  2. If there is a refusal on the application, then we will inform and assist in making a refutation letter for the refusal.

  3. When the objection is rejected, we will assist in making an appeal letter.

  4. Reporting every progress of the registration application that has been submitted periodically.

  5. Pay attention to the Intellectual Property Rights of other parties that have similarities with the Client's Intellectual Property Rights.

  6. Inform and offer clients to file an opposition against other parties who apply for similar Intellectual Property Rights.

  7. Remind to extend the validity period of Intellectual Property Rights.

  8. Informing if there are changes to regulations regarding Intellectual Property Rights.
